Around the Web: Updates on Construction Law and Wolfe Law Group 4/16/09
Chinese Drywall is still in the news and a hot topic among construction lawyers, as evidenced by some of the below blog posts. Also, with the ABA Green Building Conference in New Orleans, LA, talk on green building has spiked.
- Re: Chinese Drywall, Wolfe Law Group's Chinese Drywall Blog asked two questions this week: (1) Are Builders Getting a "Free Pass" because of Class Actions; and (2) Are Builders and Homeowners supposed to be Mitigating Their Losses?
- Stark & Stark's Donald Brenner mentioned our "Free Pass" article in its own post, asking Whether Chinese Drywall Class Action Suits Will Ever Help Homeowners?
- The ABA Green Building Conference is in New Orleans this weekend, and Chris Cheatham is attending, posting updates on his blog and starting conversations about his newly coined term: LEEDigation.
- And, unfortunately, there is some bankruptcy news out there. In New Orleans, Oakwood and Riverwalk malls have filed bankruptcy. Nationally, General Growth Properties, Inc. filed for Chapter 11 protection. For those doing construction work on any of these properties (and there are many), having a construction lien filed pre-bankruptcy is the best way to position yourself in the line of creditors.
